By accepting these Terms, you agree to be bound by these Terms and conditions.

  1. Overview

    As Glamuare, our goal is to offer the best service for our users. We’ve worked hard on making our Terms and Conditions as easy and clear as possible. Please read these Terms and Conditions carefully. They include important information about how you can use our services, activities that you are prohibited from, and your rights. You must read these Terms and Conditions carefully and agree to them prior to accessing and using Glamuare mobile application, services, and/or websites. If you do not agree to these Terms, do not access mobile applications, services, and/or websites.

    1. About Us

      We are Glamuare Cosmetics Limited, a company registered in Ireland with company number 688659. E-mail: info@glamuare.com We understand this is a big responsibility and we work hard in giving our users the best experience on our platform possible. Glamuare's goal is to become a one-step platform for all your needs within the cosmetics industry. We prioritize user experience and the protection of personal information.

    2. Definition

      • "Glamuare" means any of its subsidiaries or affiliates (“we” or “us”).
      • "Glamuare Marks or Works" means Glamuare or its licensor’s company names, logos, products or service names, trademarks, service marks, trade dress, other indicia of ownership, or copyrights.
      • "Booking Services" mean appointment-scheduling services that we offer to our users via the Glamuare application.
      • "Booking" means appointments that users make for services with third-party service providers via the Glamuare platform.
      • "User" means any individual who uses Glamuare App to make, schedule, and change appointments.
      • "Services" means all services that we provide to our users on Glamuare App and Website.
      • "App" means Glamuare mobile application provided on mobile app platforms.
      • "Third Party Providers" are independent third parties that provide their services on our App and that you can schedule a booking through our App. These providers include, but are not limited to, independent hair salons, beauty salons, and nail salons.
      • "Third Party Services" include, but are not limited to, services and goods in the field of cosmetics and beauty provided to you by independent Third Party Providers. These are made available to you through the use of the App(s)/Website(s) Services, as defined below.
  2. The App/Website/Services

    The services provided to you by Glamuare consist of:

    1. Access and Use

      Access to and use of Glamuare mobile application and/or websites which enable you to make, schedule, and manage appointments with third-party service providers.

    2. Payment Collection and Processing

      Payment collection and payment processing services (including issuing invoices and receipts on behalf of Third Party Providers) allowing us to charge you and to pay charges into the bank account of Third Party Providers for Third Party Services or Glamuare for Glamuare Provided Services.

    3. Geographic Specificity

      These Terms apply to your use of the App(s)/Website(s) Services in Ireland. By accessing and using the App(s)/Website(s) Services in another country, you may be subject to country-specific terms.

    4. Independence from Third Party Service Providers

      Glamuare is independent of any Third Party Service Providers and does not exert any control over their operations and activities. Glamuare does not warrant any liabilities due to Third Party Service Providers’ legal obligations, including tax law and financial regulations.

    5. Request and Receive Third Party Services

      Where available, you can request and receive Third Party Services within the application.

    6. Role of Glamuare as Disclosed Agent

      For Third Party Services, Glamuare acts as a disclosed agent between you and the Third Party Providers to enable them to provide the Third Party Services to you. Glamuare does not provide Third Party Services. All Third Party Providers are independent third-party contractors, registered businesses, or other legal entities who are not employed by Glamuare.

    7. Information About Third Party Services

      When you are logged in, online, and in the vicinity of Third Party Providers who are also logged in Glamuare’s mobile app and/or websites, you will be given information in Glamuare mobile app and/or websites about the Third Party Services before you decide to make a request.

    8. Acceptance of Requests

      Third Party Providers (for Third Party Services) and Glamuare are free to decide to accept or reject a request. Acceptance of the request is communicated to you through Glamuare mobile applications and/or websites and will give rise to a direct contract between you and the Third Party Provider(s) (for Third Party Services) and/or between you and Glamuare (for Glamuare Provided Services).

    9. Separate Terms for Certain Services

      For some Third Party Services, you may be required to agree to separate terms prior to using such Third Party Service(s).

    10. Third Party Provider Obligations

      The Third Party Provider is responsible for any obligations that may arise from the provision of the Third Party Services.

  3. Using Glamuare App/Website/Services

    1. Device and Network Access

      Glamuare mobile apps and/or websites can be downloaded or accessed on most modern mobile devices with an internet connection and equipped with popular operating systems such as Android or iOS.

    2. Network Access and Fees

      You are responsible for obtaining the network access necessary to use the App(s)/Website(s) Services and are responsible for any rates and fees from your mobile network provider, including from data consumption while using Glamuare’s mobile apps and/or websites. You are also responsible for accessing compatible devices and operating systems necessary to use the App(s)/Website(s) Services, including any software or hardware updates.

    3. Registration and Account Setup

      To use the App(s)/Website(s) Services, you must register in Glamuare mobile apps and/or websites and set up an account. At the time of registration, you must either be eighteen (18) or the age of legal majority in the country where you register if different from eighteen (18), unless the terms governing the specific Third Party Service or Glamuare Provided Service impose different age requirements. By accessing and/or using Glamuare Services or by agreeing to these Terms & Conditions, you warrant that:

      • You are at least eighteen(18) years old or at another age determined by the laws that you are subjected to (in some jurisdictions twenty-one(21) years old);
      • You are not prohibited by law from agreeing to these Terms & conditions or from accessing and/or using our Services.
    4. You are not prohibited by law from agreeing to these Terms & conditions or from accessing and/or using our Services.

      You must provide us with certain personal information to register, including your phone number and email address. To use the App(s)/Website(s) Services, Glamuare Services, or certain Third Party Services, you may need to provide at least one valid payment method (credit card, debit card, or any other accepted payment method). You may need to provide additional information, such as your address and documents, before using certain Glamuare Services or Third Party Services.

    5. No Obligation to Use

      You are under no obligation to log in to, or use, Glamuare mobile apps and/or websites, and neither are the Third Party Providers. If you choose to stop using Glamuare mobile apps and/or websites you may do so without giving us any notice.

    6. Temporary Restrictions

      We may temporarily restrict your access to and use of the App(s)/Website(s) Services if there is a suspected breach of your obligations (see Section 6) or of these Terms, including where we receive a complaint in relation to fraud. There may be circumstances in which we are unable to provide you with information about the complaint whilst an investigation is ongoing (by us and/or a third party such as the police).

  4. Your Obligations

    1. Lawful Use

      When using the App(s)/Website(s) Services, you must comply with all applicable laws. You may only use the App(s)/Website(s) Services for lawful purposes and for the purposes for which they were intended as otherwise referenced in these Terms. You must not misuse Glamuare’s mobile apps and/or websites or attempt to defraud either us or Third Party Providers.

    2. Accurate Information

      You must provide accurate and complete information when you register an account and when using the App(s)/Website(s) Services. If we suspect on reasonable grounds that you provided misleading or inaccurate information, we can block your account or restrict your access to and use of our App.

    3. Personal Account Responsibility

      Your account is personal to you. It cannot be licensed or shared unless expressly permitted by Glamuare. Once you have set up an account, you:

      • May not register more than one account unless we agree otherwise in writing;
      • May not allow third parties to use your account or transfer your account to a third party;
      • Must keep your account information accurate, complete, and up-to-date;
      • Must keep your account information secure, including any username, passwords, and/or access codes.
    4. Communication and Contact

      By creating an account, you agree that we may send you text messages, push notifications, and emails as part of the normal business operation of your use of the App(s)/Website(s) Services. You may opt-out of receiving text messages and push notifications from us at any time.

    5. Cooperation

      You agree to cooperate with us in all matters relating to the App(s)/Website(s) Services. We will rely on the information that you provide us in relation to the provision of the App(s)/Website(s) Services, and we will not independently verify the accuracy of any information you provide.

    6. Payments

      You agree to pay all charges incurred by you or on your behalf through the App(s)/Website(s) Services.

  5. Prohibited Activities

    1. No Unlawful Activity

      You agree not to use Glamuare mobile apps and/or websites for any unlawful activity, including fraud, deception, money laundering, bribery, terrorism, or any activity prohibited by applicable law.

    2. No Interference

      You agree not to interfere with the proper working of Glamuare mobile apps and/or websites or engage in any activity that would undermine the operation, security, integrity, or stability of Glamuare mobile apps and/or websites, including, but not limited to:

      • Attempting to access or search any part of the Glamuare Services by any means other than through our available interfaces and according to our policies.
      • Interfering with or disrupting the integrity or performance of our Services or the data contained therein.
      • Using any means to “scrape,” “crawl,” or “spider” any part of the Glamuare Services.
    3. No Reproduction

      You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Glamuare mobile apps and/or websites without our express written permission.

    4. No Infringement

      You agree not to violate, infringe, or misappropriate any third-party rights, including intellectual property rights, in your use of Glamuare mobile apps and/or websites.

    5. No Misrepresentation

      You agree not to falsely imply a relationship with Glamuare, or falsely state or otherwise misrepresent your affiliation with a person or entity.

    6. Prohibited Materials

      You agree not to upload or transmit any materials through Glamuare mobile apps and/or websites that are:

      • Harmful, abusive, defamatory, obscene, or otherwise objectionable.
      • Contain viruses, malware, or other malicious software.
  6. Charges and Payment

    1. Payment Obligations

      You agree to pay for all Third Party Services and Glamuare Provided Services that you book through the App(s)/Website(s) Services. Charges will be inclusive of applicable taxes where required by law.

    2. Authorizations

      You authorize Glamuare to charge your chosen payment method for the charges incurred and to facilitate the payment to the Third Party Provider(s) for Third Party Services and to Glamuare for Glamuare Provided Services.

    3. Charges for Third Party Services

      Charges for Third Party Services are determined by Third Party Providers and may include applicable taxes. Third Party Providers may also charge additional fees for extra services or products provided at the time of the appointment.

    4. Charges for Glamuare Provided Services

      Charges for Glamuare Provided Services are determined by Glamuare and may include applicable taxes.

    5. Payment Processing

      Payment processing services for Third Party Services are provided by our payment processing partners. Your payment method will be charged at the time of booking, or when the Third Party Service is provided. In some cases, you may authorize a charge for the full estimated amount at the time of booking, with any adjustments for additional services or products charged at the time of service delivery.

    6. Disputes

      If you dispute any charges, you must notify Glamuare in writing within 30 days after the date the charge is made. We will attempt to resolve the dispute promptly.

    7. Changes in Pricing

      Prices for Third Party Services and Glamuare Provided Services may change from time to time at the discretion of the Third Party Providers or Glamuare. Any changes in pricing will be reflected in the App(s)/Website(s) Services and will apply to bookings made after the change is posted.

  7. Booking, Cancellation and Refund Policy

    • Booking

      You may book Third Party Services through the App(s)/Website(s) Services. Once a booking is confirmed, you will receive a confirmation email or notification through the App(s)/Website(s).

    • Cancellation by User

      You may cancel a booking for Third Party Services through the App(s)/Website(s) Services. The cancellation policy of the Third Party Provider will apply, and you may be charged a cancellation fee if you cancel within the time frame specified by the Third Party Provider.

    • Cancellation by Third Party Provider

      Third Party Providers may cancel a booking for Third Party Services for reasons such as illness or unforeseen circumstances. In such cases, you will receive a full refund of any charges paid.

    • Refunds

      Refunds for Third Party Services will be handled according to the cancellation policy of the Third Party Provider. Refunds for Glamuare Provided Services will be handled according to Glamuare’s refund policy. If you are entitled to a refund, the refund will be processed through the original payment method.

  8. License

    1. License Grant

      Subject to your compliance with these Terms, Glamuare grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

      • Access and use the App(s)/Website(s) Services on your personal device solely in connection with your use of the App(s)/Website(s) Services.
      • Access and use any content, information, and related materials that may be made available through the App(s)/Website(s) Services, in each case solely for your personal, non-commercial use.
    2. License Restrictions

      You shall not:

      • License, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the App(s)/Website(s) Services.
      • Modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the App(s)/Website(s) Services.
      • Access the App(s)/Website(s) Services in order to build a similar or competitive product or service.
      • Copy, reproduce, distribute, republish, download, display, post, or transmit any part of the App(s)/Website(s) Services in any form or by any means, except as expressly stated in these Terms.
  9. Intellectual Property

    1. Ownership

      The App(s)/Website(s) Services and all rights therein are and shall remain Glamuare’s property or the property of Glamuare’s licensors. Neither these Terms nor your use of the App(s)/Website(s) Services convey or grant to you any rights in or related to the App(s)/Website(s) Services except for the limited license granted above.

    2. Glamuare Marks

      You are not authorized to use Glamuare Marks in any advertising, publicity, or in any other commercial manner without the prior written consent of Glamuare, which may be withheld for any or no reason.

    3. Feedback

      You may provide feedback, comments, and suggestions for improvements to the App(s)/Website(s) Services (“Feedback”). Glamuare will own any and all rights to the Feedback and is entitled to use the Feedback without restriction or compensation to you.

  10. Privacy Notice

    1. Privacy Policy

      Your use of the App(s)/Website(s) Services is also governed by Glamuare’s Privacy Policy, which is incorporated into these Terms by this reference. Please review the Privacy Policy carefully before using the App(s)/Website(s) Services.

  11. Your Liability and Indemnity

    1. Indemnity

      You agree to indemnify, defend, and hold harmless Glamuare, its directors, officers, employees, contractors, agents, licensors, and service providers, from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses arising from:

      • Your use of and access to the App(s)/Website(s) Services.
      • Your violation of any of these Terms.
      • Your violation of any third-party right, including without limitation any intellectual property, or privacy right.
  12. Disclaimer

    1. No Warranty

      Glamuare makes no representation, warranty, or guarantee as to the reliability, timeliness, quality, suitability, availability, accuracy, or completeness of the App(s)/Website(s) Services. Glamuare does not represent or warrant that:

      • The use of the App(s)/Website(s) Services will be secure, timely, uninterrupted, or error-free.
      • The App(s)/Website(s) Services will meet your requirements or expectations.
      • Any stored data will be accurate or reliable.
